1. Acceptance of Terms

By accessing or using Pulse ("the Service"), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree to these terms, you may not access or use the Service.

2. Description of Service

Pulse is a business operations and inventory management platform designed for pest control and field service companies. The Service provides tools for managing work orders, customer accounts, employee scheduling, route management, materials tracking, and business analytics. We reserve the right to modify, suspend, or discontinue any part of the Service at any time with or without notice.

3. User Accounts

You must provide accurate, complete, and current information when creating an account. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You may not share your credentials with others or allow unauthorized access. Notify us immediately if you suspect any unauthorized use of your account.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable regulations
• Upload or transmit viruses, malware, or any other malicious or harmful code
• Attempt to gain unauthorized access to any portion of the Service or its infrastructure
• Attempt to access data belonging to another organization or tenant
• Interfere with or disrupt the integrity, performance, or availability of the Service
• Reverse engineer, decompile, or disassemble any part of the Service
• Scrape, harvest, or collect data from the Service without our express written consent
• Use the Service to transmit unsolicited communications or spam
• Impersonate any person or entity or misrepresent your affiliation

5. Your Business Data

You retain full ownership of all business data, customer records, uploaded files, and other operational content you create or store within the Service ("Your Data"). We store Your Data on your behalf solely to deliver the Service to your organization. We do not access, analyze, mine, or use Your Data for any purpose beyond operating the Service for you — including analytics, product improvement, or any commercial purpose. Your customers' personal information contained within Your Data is subject to the same protection.

By using the Service, you represent that you have all necessary rights, consents, and permissions to upload and process the data you store within the platform, including any personal information of your customers, in compliance with applicable privacy laws.

6. Anonymous Analytics

To improve the Service and develop new features, we collect anonymous, aggregated signals about how users interact with the application interface — such as which pages are visited, which features are used, and general navigation patterns. This analytics data:

• Contains no business content and no personal information belonging to you or your customers
• Is never linked to individual tenant accounts or used to identify specific users
• Is never sold or shared with third parties for advertising or any other commercial purpose
• Is used exclusively to understand usage patterns, fix issues, and guide product development

7. Data Isolation

The Service is designed so that each organization's data is logically isolated from all other organizations. You will not have access to data belonging to another tenant, and other tenants will not have access to yours. We maintain technical and organizational measures to enforce this separation.

8. Intellectual Property

The Service and its original content, features, user interface, and functionality are protected by copyright, trademark, patent, trade secret, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Service without our prior written consent. Nothing in these Terms transfers any intellectual property rights to you.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, completely secure, or free of harmful components.

10. Limitation of Liability

To the maximum extent permitted by applicable law, we and our officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from or related to your use of the Service. Our total aggregate liability shall not exceed the amounts paid by you for the Service in the twelve months preceding the claim.

11. Indemnification

You agree to defend, indemnify, and hold harmless the Service operator and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or related to your use of the Service, Your Data, or your violation of these Terms — including any claim that Your Data infringes a third-party right or violates applicable privacy law.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved exclusively in the competent courts of the United States.

13. Changes to Terms

We may update these Terms of Service at any time. When we make material changes, we will update the "Last updated" date at the top of this page and notify registered users by email. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.

14. Termination

We reserve the right to suspend or terminate your account and access to the Service at our sole discretion, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. You may terminate your account at any time by contacting us through the Service.
